1. Scope and provider
These Terms of Use apply to the use of the website lt-systems.de, including the German and English language versions (hereinafter the “Website”), of LT-Systems Europe GmbH (hereinafter “we” or “LT-Systems”).
They govern solely the use of the Website. They are not terms of sale, delivery or payment. Terms of sale, delivery and payment apply only if we later submit a separate offer to you or a contract is concluded by other means.
Deviating terms of the user do not apply unless we expressly agree to their applicability in writing.
The provider of the Website is:
LT-Systems Europe GmbH
Hamburger Str. 18
41540 Dormagen
Further details can be found in the Impressum.
2. Nature of the Website – not an online shop
The Website is a corporate presence with a product catalogue for business customers. You may view and search products, add them to an inquiry cart, submit product enquiries, use contact forms, download files and create a user account.
No online purchase takes place via the Website. There is no order, no payment, no price calculation in the inquiry cart and no shipping processing.
The presentation of products, prices (where stated), technical data, images and downloads is non-binding and does not constitute a legally binding offer within the meaning of Section 145 of the German Civil Code (BGB). It serves information purposes and the preparation of an enquiry.
3. Intended users
The Website is aimed at entrepreneurs within the meaning of Section 14 BGB and other business customers (companies, public authorities, commercial users).
Use by consumers within the meaning of Section 13 BGB is not the intended purpose of the Website. A statutory right of withdrawal under the rules on distance contracts does not arise from using the Website, registering or submitting an enquiry, because no consumer contract for the supply of goods or the provision of paid services is concluded thereby.
4. No purchase contract via the Website
Creating an account, saving products in the inquiry cart, submitting a product enquiry or submitting the contact form does not create a purchase contract or any other paid performance obligation.
A product enquiry is a non-binding request for information or a quotation. We are not obliged to reply, to submit an offer or to conclude a contract.
Any later contract for delivery or performance is concluded only if we submit a separate offer in writing or in text form and you accept it, or if we expressly confirm an order in text form. For such a contract, the terms stated therein apply, not these Website Terms of Use.
5. User account
A user account is required for the inquiry cart, product enquiries and downloads. Registration is carried out with name, e-mail address and password. For confirmation we may send a time-limited code to your e-mail address.
You are obliged to provide accurate information and to keep access credentials confidential. Actions taken via your account will be attributed to you to the extent you are responsible for the use.
We may disable or delete an account if you breach these Terms of Use, provide false information, or misuse is to be feared.
You may request deletion of your account using the contact details given in the Impressum. Statutory retention obligations, in particular for enquiries already submitted, remain unaffected.
Details on the processing of personal data are set out in the Privacy Policy.
6. Inquiry cart and product enquiries
The inquiry cart is not a shopping cart. It serves only to compile selected products and quantities and to transmit them to us.
A user account is required for the inquiry cart and for a direct enquiry. When submitting an enquiry you transmit name, e-mail address, optionally telephone number and message, as well as the requested products and quantities.
Unavailable products are not included in the enquiry. Information on products, availability, dimensions and technical data may change.
The enquiry is stored by us and forwarded to us by e-mail so that we can contact you and, where appropriate, prepare an offer. There is no entitlement to an offer or to delivery.
7. Contact form and other contact
Via the contact form you may send general enquiries (name, e-mail address, optionally subject, telephone number and message). Before submission we obtain your consent to data-protection-related processing.
You may also contact us by e-mail, telephone or fax. Contact details can be found in the Impressum and on the contact page.
The processing of personal data is governed by the Privacy Policy.
8. Downloads
In the download area, logged-in users may download provided files (e.g. PDF catalogues). The files are for information purposes. They do not constitute an offer and do not grant a licence for any use beyond your own internal use, unless expressly indicated otherwise.
The contents of the downloads remain our intellectual property or that of the respective rights holders. Resale, making them publicly available or adaptation is not permitted without our prior consent.
9. Website content and intellectual property
All content of the Website (texts, images, graphics, product images, logos, layout, downloads) is protected by copyright or other intellectual property rights, unless otherwise indicated.
Use beyond the intended visit of the Website – in particular reproduction, distribution, public communication, or extraction by automated retrieval (crawling/scraping) beyond ordinary use – is not permitted without our prior consent.
Product images and descriptions may differ from the goods later supplied. Printing errors, mistakes and technical changes are reserved.
10. Availability
We endeavour to operate the Website without disruption. There is no entitlement to uninterrupted availability. Maintenance, technical faults, force majeure or changes to the offering may lead to interruptions or restrictions.
We may change or discontinue content, functions or the entire Website at any time, unless mandatory statutory obligations prevent this.
11. Liability
We are liable without limitation in cases of intent and gross negligence and for injury to life, body or health.
In the event of slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes proper use of the Website possible in the first place and on whose compliance the user may regularly rely), our liability is limited to the typical, foreseeable damage.
Otherwise, liability for slight negligence is excluded.
The foregoing limitations do not apply insofar as we have fraudulently concealed a defect or assumed a guarantee, or for claims under the German Product Liability Act (Produkthaftungsgesetz).
We assume no responsibility for the content of external websites to which we merely link. The respective providers are responsible for that content.
12. Links to social networks and Google Maps
Links to social networks (e.g. Facebook, Instagram, LinkedIn, YouTube) may be provided in the footer. These are simple references, not embedded plugins. By clicking them you leave our Website.
Google Maps is embedded on the contact page. Details on data processing can be found in the Privacy Policy.
13. Data protection
The collection and processing of personal data when visiting and using the Website is governed by our Privacy Policy, available via the “Datenschutz” / Privacy Policy link in the footer of the Website.
14. Changes to these Terms of Use
We may adapt these Terms of Use if the Website, the legal situation or other circumstances change. The current version will be published on the Website and applies to further use from the time of its publication.
For enquiries already submitted before the change, the terms applicable at the time of submission continue to apply, unless mandatory law provides otherwise.
15. Applicable law and place of jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Insofar as you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the use of the Website is Dormagen or the court with subject-matter jurisdiction at the registered seat of LT-Systems. We remain entitled to sue you also at your general place of jurisdiction.
Mandatory consumer protection provisions of your country of residence remain unaffected insofar as they apply by operation of law.
16. Final provisions
Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory rule.
The contractual language of these Terms of Use is German. Insofar as an English version is provided, it is for guidance only. In the event of discrepancies, the German version prevails.
